1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Pascual J. Ruiz ("MODUSYN", "we", "us", or "our") governing your access to and use of the MODUSYN mobile application and associated website (https://modusyn.app).
By downloading, installing, accessing, or using MODUSYN, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the application or website.
2. Educational Nature of the Service
MODUSYN is designed exclusively to measure execution discipline and behavioral patterns based on user-entered trade logs.
- No Broker Connectivity: MODUSYN does not execute orders, connect to brokerage trading APIs, hold funds, or manage assets.
- No Causality Claims: MODUSYN measures behavioral changes relative to empirical baselines. It does not claim that software tools cause market success or guarantee risk reduction.
- AI Coaching Limitations: AI Coaching guidance generated within MODUSYN Pro provides educational reflection frameworks based on statistical summaries. It must never be construed as financial instructions or trading advice.
3. Local-First Architecture & Data Responsibility
MODUSYN operates under a local-first design. Your trade records and reflection notes are stored directly on your mobile device in an SQLite database.
- You acknowledge that MODUSYN does not maintain cloud backups of your raw trade logs or notes.
- You are solely responsible for backing up your device and safeguarding your device access.
- Uninstalling the app or executing "Delete Local Data" permanently purges your on-device records.
4. Subscriptions & Billing (MODUSYN Pro)
MODUSYN offers an optional auto-renewing subscription tier ("MODUSYN Pro") unlocking advanced AI Coaching capabilities.
- Google Play Billing: All purchases and subscriptions are processed directly through Google Play in accordance with Google Play Terms of Service.
- Auto-Renewal: Subscriptions automatically renew at the specified interval unless cancelled at least 24 hours prior to the end of the current billing cycle.
- Cancellation: You may cancel or manage your subscription at any time through your Google Play account settings at Google Play Subscriptions.
- Refunds: Refund requests are subject to Google Play refund policies.
5. User Conduct & Restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the application or gateway infrastructure.
- Circumvent or attempt to bypass entitlement checks, rate limits, or security controls on the Edge AI Gateway.
- Use MODUSYN for any illegal purpose or in violation of applicable financial or market regulations.
6. Intellectual Property
All rights, title, and interest in and to MODUSYN, including software, algorithms, visual interfaces, trademarks, and documentation, are the exclusive property of Pascual J. Ruiz and licensors.
7. Disclaimer of Warranties & Limitation of Liability
MODUSYN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PASCUAL J. RUIZ DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL PASCUAL J. RUIZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.
8. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of Spain, without prejudice to any mandatory consumer protection rights that may apply under the laws of your country of residence.
